L8ve.co Company Overview

L8ve.co provides prepaid gifts, flowers, notes, and other services to individuals identified by the Client. These services will begin upon the Client’s passing and continue as directed by the Client. It is the goal of L8ve.co and the intention of the parties to allow the Client to posthumously provide comfort and love to the Client’s loved ones by providing thoughtful and caring gifts and notes/letters to the Client’s loved ones. These services will be prepaid by the Client or estate and arranged for and provided by L8ve.co on the Client’s behalf.

Services Invoice Security

Service invoices are done by Wave Payments. Wave Payments is a PCI Level 1 Service Provider.

What is PCI?

The Payment Card Industry Data Security Standard (PCI DSS) is a set of requirements designed to ensure that all companies that process, store or transmit credit card information maintain a secure environment. The (PCI) Data Security Standards represents a common set of industry tools and measurements to help ensure the safe handling of sensitive information.

L8ve.co will contact the Client regarding services or to answer questions. As a subscriber, L8ve.co will periodically contact you regarding our services.

Except as required to fulfill the company’s obligations under the contract, L8ve.co will not, without Client's prior written authorization, reveal or make available any confidential information obtained to any third party.

L8ve.co uses cookies for many important reasons, such as:

To provide a great experience for our visitors and Clients.
To identify our registered members (users who registered).
To monitor and analyze the performance, operation, and effectiveness of the platform.
To ensure our platform is secure and safe to use.

Meeting With Consultant

L8ve.co prefers to meet with the Client by using Zoom.us video conferencing. Using Zoom conferencing enables the consultant to show the contract and reports. If the Client prefers, the consultant can do the meeting over the phone. The Client must contact the consultant to request this.

Money-Back Guarantee

All setup fees are fully refundable up until the signing of the contract.

If we are unable to perform the service, all related service charges will be refunded.

In the event, L8ve.co is unable to provide a service, and the Client has not authorized a substitution, the company will refund the amount the Client or Trustee paid for that service to the Trustee.

Setup Fees

Before booking a meeting with a L8ve.co consultant, the Client pays a setup fee. It is either monthly or one-time. This fee is refundable up until the contract is signed. The fee covers the cost of L8ve.co consultant's time (Spent on one on one meetings with the Client through Zoom conferencing).

Standard Fee structure: $199 one-time or $19 a month for 12 months

Custom Fee structure: $299 one-time or $29 a month for 12 months

The standard plan is when the Client selects one of the 'standard plans.'
The custom plan is completely customizable. This plan includes 'custom deliveries.'

Service Fees

The Client may pay for the services upfront or L8ve.co can bill the estate upon notification of the beginning of the contract.

L8ve.co shall hold all prepaid and otherwise unearned funds paid by Client or Client’s Trustee, Guardian, Custodian, Executor, or Personal Representative in an L8ve.co account. L8ve.co shall not make use of such funds other than to fulfill the services identified in the contract. All interest accrued on such funds shall belong to the L8ve.co. In the event the agreement is terminated due to Client’s failure to make payments as required, L8ve.co shall retain all funds paid by Client as liquidated damages.

Services fees:

$2 a text message.
$10 a personal letter.
Flowers or custom delivery: Cost-plus 25% for each gift (flowers, stuffed animals, balloons, cakes, or any other gifts as identified by Client)
- This “cost” will be determined at the time the invoice is generated at the current market price for each such item/gift. In the event the “cost” of any such item increases during the term that contracted services are provided by the L8ve.co by more than 25%, the Company may submit another invoice to Client’s Trustee, Guardian, Custodian, Executor, or Personal Representative to cover such increased costs.

Contract

The contract with L8ve.co should be kept with the Client's Will, and the Client should ensure the Trustee receives it when necessary.

The contract is sent as a DocuSign.

Electronic signatures, whether digital or encrypted, in the agreement, are intended to authenticate this writing and to have the same force and effect as manual signatures. Delivery of a copy of this agreement or any other document contemplated hereby bearing an original or electronic signature by facsimile transmission (whether directly from one facsimile device to another utilizing a dial-up connection or whether mediated by the world wide web), by electronic mail in “portable document format” (“.pdf”) form, or by any other electronic means intended to preserve the original graphic and pictorial appearance of a document, will have the same effect as physical delivery of the paper document bearing an original or electronic signature.

Client or Trustee Contract Obligations

For L8ve.co to be obligated to perform services, The Client or Trustee's obligations are:

Complete payment of setup fee and services invoice. The Trustee or Client will receive a separate invoice.
The Trustee must notify us of passing in writing or by email.
The Trustee needs to inform L8ve.co of any changes to the recipients or trustee contact details at contract execution.
The Client will include the language of the following form/effect in the appropriate estate planning documents:

[Client’s Name] has entered into a POSTHUMOUS GIFT SERVICES AGREEMENT with Tesla Trader Company, a Utah corporation doing business as L8VE.CO ("Company") wherein the Company has agreed to provide certain gifts, notes, messages to [Client’s Name]’s family and friends. [Client Name] hereby instructs, directs, and authorizes his/her Trustee, Guardian, Custodian, Executor, or Personal Representative to (i) provide timely notice to the Company of [Client’s Name]’s death, incapacitation, or incompetency, and (ii) make timely payments to the Company on all invoiced amounts from the Company.

L8ve.co Contract Obligations

Obligation to perform services begins 60 days after notification of contract execution.
Funds will be refunded if L8ve.co is unable to perform service.

Upon activation, L8ve.co agrees to provide on Client’s behalf the services identified. L8ve.co shall devote its best efforts to provide the services as described in the contract. Unless Client expressly states otherwise, where the exact services are not commercially practicable to provide, L8ve.co is authorized to make necessary substitutions to maintain the same quality and kind of service requested initially by Client. For example, if L8ve.co cannot reasonably obtain a specific gift or color, the company will exercise its best efforts to match the quality and kind of gift.

L8ve.co represents and warrants to Client that: i) it has the right and capacity to enter into an agreement and fully perform all of its obligations in the contract, and ii) it shall use all commercially reasonable efforts to perform the services and responsibilities in good faith.
